3. Legal Basis for Processing
We process your data under Article 6(1) of the GDPR: (a) your explicit consent given by submitting the contact form; (b) performance of a contract or pre-contractual measures at your request; (c) compliance with legal obligations; and (d) our legitimate interest in improving services and preventing fraud.

4. Data Retention
Personal data submitted via contact forms is retained for a maximum of 24 months from the last interaction, unless a contractual relationship is established, in which case data is retained for the duration of the contract plus 6 years as required by Spanish tax and commercial law. Analytics data is aggregated and anonymized after 26 months.

5. Data Sharing
We do not sell, trade, or rent your personal data to third parties. Data may be shared with: (a) hosting and infrastructure providers necessary for website operation; (b) email service providers for transactional communication; (c) payment processors solely for billing purposes; and (d) legal authorities when required by law. All third-party processors are bound by Data Processing Agreements (DPAs) compliant with Article 28 GDPR.

6. International Data Transfers
Some of our service providers may be located outside the European Economic Area (EEA). In such cases, we ensure that appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) approved by the European Commission, to guarantee an adequate level of data protection.

7. Your Rights Under GDPR
You have the right to: (a) access your personal data (Article 15); (b) rectify inaccurate data (Article 16); (c) request erasure of your data (Article 17); (d) restrict processing (Article 18); (e) data portability (Article 20); (f) object to processing (Article 21); and (g) withdraw consent at any time without affecting the lawfulness of prior processing. DynamicSignalWorks does not engage in automated decision-making or profiling that produces legal effects concerning you or similarly significantly affects you.

Refund Policy

1. Scope
This Refund Policy applies to all services provided by DynamicSignalWorks, C. San Ignazio Kalea 40A, Ondarroa, Bizkaia, Espana. It governs refunds for web development, design, consulting, SEO, marketing, and any other professional services rendered.

2. Project-Based Services
For fixed-scope projects, payments are structured around agreed milestones. If a project is cancelled before a milestone is completed, you are entitled to a refund of any advance payment for that specific uncompleted milestone. Work already completed and delivered at previous milestones is non-refundable.

3. Recurring Services
For monthly retainer or subscription-based services (e.g., ongoing SEO, social media management, hosting), you may cancel with 30 days' written notice. Refunds for the current billing period are not provided unless the service has not yet commenced. Pre-paid annual plans may be refunded on a pro-rata basis for unused months, minus a 10% administrative fee.

4. Digital Products & Deposits
Deposits and down payments made to initiate a project are refundable in full only if DynamicSignalWorks has not commenced any work. Once work has begun, deposits become non-refundable and are applied against the total project cost.

5. Requesting a Refund
To request a refund, send an email to [email protected] with your name, project reference, and the reason for the refund request. We will review your request within 5 business days and respond with a decision or request for additional information.

6. Processing Time
Approved refunds are processed within 14 business days using the original payment method. Bank processing times may vary. Refunds are issued in Euros (EUR) and any currency conversion fees are the responsibility of the client.

7. Exceptions
Refunds will not be issued for: (a) work that has been delivered, reviewed, and approved by the client; (b) third-party costs incurred on the client's behalf (domain registrations, hosting fees, stock assets, API charges); (c) services rendered in full compliance with the agreed scope and timeline; or (d) projects delayed due to client non-responsiveness exceeding 30 days.

8. Dispute Resolution
In the event of a refund dispute, both parties agree to attempt resolution through good-faith negotiation within 30 days. If no resolution is reached, the dispute shall be subject to the exclusive jurisdiction of the courts of Bizkaia, Espana, in accordance with applicable Spanish and EU consumer protection law.

Terms of Service

1. Agreement
By engaging the services of DynamicSignalWorks, C. San Ignazio Kalea 40A, Ondarroa, Bizkaia, Espana, you ("the Client") agree to be bound by these Terms of Service. These terms apply to all services, projects, and deliverables provided by DynamicSignalWorks ("the Provider").

2. Scope of Work
All projects begin with a written proposal or statement of work (SOW) that defines the scope, deliverables, timeline, and pricing. Any work requested outside the agreed scope constitutes a change request and may incur additional fees. Change requests must be approved in writing before work begins.

3. Payment Terms
Invoices are payable within 14 days of issuance unless otherwise agreed in writing. A 50% deposit is required before work commences on fixed-scope projects. Late payments incur a penalty of 1.5% per month on the outstanding balance. The Provider reserves the right to pause work if payments are overdue by more than 15 days.

4. Intellectual Property
Upon full payment, the Client receives full ownership of all custom deliverables created specifically for their project, including source code, design files, and written content. The Provider retains the right to use anonymized case studies, screenshots, and project descriptions for portfolio and marketing purposes unless the Client explicitly requests otherwise in writing.

5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the course of the engagement. This includes business strategies, financial data, source code access credentials, and any information marked as confidential. This obligation survives the termination of the agreement for a period of 2 years.

6. Warranties & Limitations
DynamicSignalWorks warrants that all deliverables will be free from material defects and will conform to the specifications defined in the SOW for a period of 30 days after delivery. The Provider is not liable for: (a) issues arising from third-party services, plugins, or hosting environments; (b) modifications made by the Client or third parties after delivery; (c) indirect, incidental, or consequential damages; or (d) total liability exceeding the total amount paid under the relevant project.

7. Termination
Either party may terminate the agreement with 30 days' written notice. In the event of termination, the Client is obligated to pay for all work completed up to the termination date. If the Client terminates without cause, any deposit paid is non-refundable. The Provider may terminate immediately if the Client breaches material obligations, particularly payment terms.

8. Data Protection
Both parties agree to comply with the EU General Data Protection Regulation (GDPR) and the Spanish Organic Law 3/2018 on Data Protection (LOPDGDD). The Provider acts as a Data Controller for website analytics and as a Data Processor for any Client data processed within project deliverables, as governed by a separate Data Processing Agreement where applicable.

9. Force Majeure
Neither party shall be liable for delays or failure to perform caused by circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, government actions, internet infrastructure failures, or cybersecurity incidents. The affected party must notify the other within 48 hours of the event and use reasonable efforts to mitigate its impact.

10. Governing Law
These Terms of Service are governed by the laws of Spain and the European Union. Any disputes arising from or related to this agreement shall be subject to the exclusive jurisdiction of the courts of Bilbao, Bizkaia, Espana. Both parties agree to attempt amicable resolution before initiating legal proceedings.
